Lealta Benefits Card Terms and Conditions of Use

These terms and conditions set out the basis on which we supply and you may use the Lealta Benefits Card ('the Card'). Please read these terms and conditions carefully and retain them for future reference.

Information About Us

The Lealta Benefits Card scheme is owned and operated by Lealta Benefits Limited ('Lealta'), registered company number 06024643, whose registered office is at Lealta House, Amy Johnson Way, Blackpool Business Park, Squires Gate Lane, Blackpool, FY4 2PR ('Lealta').

The scheme offers discounts on goods and services sold or supplied by specified retailers and/or service providers ('Participating Outlets') named on the Lealta Benefits Card website at www.lealtabenefits.com ('the Website') against the standard fees, charges and prices charged by such outlets.

Your Status

In order to use Card you must be aged 16 or over.

Use of the Card

The Card remains the property of Lealta at all times.

Each Card is valid for a period of one year from date of issue to the Card Issuer.

The Card cannot be used in conjunction with any other offer or promotion. The Card, once issued, is non transferable, not for sale, resale or redeemable for cash. The cash value of the Card is 0.001p. The Card is not a payment or payment guarantee card and may not be used as such.

The enjoyment of the discount available by using the Card is personal to you as the holder of the Card.

In order to use the Card, you must visit the Website and using your unique card number access the cardholders area of the website which details the offers and Participating Outlets. Information relating to the benefits available at any time and the Participating Outlets is posted on our website. Lealta also offers a customer support telephone service between 9am and 5pm Monday to Friday excluding public holidays and information is available through the customer support line for those who do not have internet access. In the alternative, the Cardholder may request that the Lealta Customer Services Department source a promotional offer to meet his or her requirements. Such requests should be made to the Lealta Customer Service Department and Lealta will use its reasonable endeavours to source such an offer but is unable to guarantee that it will be able to meet the cardholder's requirements.

The Card allows you as a cardholder to enjoy the discount advertised for the selected Participating Outlet, which to the extent of any conflict or inconsistency supersedes any other discount advertised in any printed literature issued by us or by any Participating Outlet.

Discounts and offers can be redeemed in accordance with the Participating Outlet's specific terms that are set out on the Website for each Participating Outlet. This may include requiring that you present your Card at the point of sale or providing the Card number to the Participating Outlet. Only genuine Cards featuring a barcode and featuring a valid number will be accepted by Participating Outlets. Where the Participating Outlet requires the presentation of your Card at the point of sale, photocopies will not be accepted.

In order to obtain the advertised discount, you must follow the directions/instructions posted on the Website. These terms and conditions must be read in conjunction with any terms and restrictions unique to each Participating Outlet shown on the Website. Individual Participating Outlets may impose additional terms or other restrictions - please check with the Participating Outlet in advance of taking up the offer. Individual Participating Outlets retain the right to vary prices and/or availability without notice.

The details of the Participating Outlets published on the Website are based upon information supplied by the Participating Outlets and may be subject to change without notice. Whilst every care has been taken to ensure the accuracy of such detail at the time of publication of the Website, you must telephone the Participating Outlet prior to booking travel or other arrangements to check that all published information is correct.

No exchanges or replacements can be made for Cards not used after their final validity date.

Our Liability

The Card cannot be used in conjunction with any other short term incentive, discount, promotion or otherwise which the Participating Outlets may from time to time advertise. It is up to you to check whether the Participating Outlet is offering a more favourable rate, price, promotion or discount than available through the Card and we accept no liability for you having used the Card instead of having taken advantage of a more favourable short term incentive, price or discount, promotion or otherwise.

Whilst each Participating Outlet has confirmed its willingness to participate in this offer, Lealta cannot be held responsible for any Participating Outlets declining acceptance of the Card for reasons of their own, nor can they be held responsible should any Participating Outlet cease to trade. Lealta can accept no liability for loss or personal injury suffered at Participating Outlets except to the extent that Lealta are required to accept such liability by law. This does not affect any of your statutory rights as a consumer. In the unlikely event that the Participating Outlet fails to honour the discount as advertised on the Website, you should request a receipt for the transaction with the Participating Outlet, and forward this to Lealta, Lealta House, Amy Johnson Way, Blackpool Business Park, Squires Gate Lane, Blackpool, FY4 2PR and Lealta will provide you with, in its sole discretion, cash or vouchers to the same value as the discount which was offered provided that all terms and conditions relating to the offer have been met by you.

Lealta shall not be held responsible for the suitability or quality or otherwise of goods or services supplied by a Participating Outlet. Any dispute must be settled direct with the Participating Outlet concerned.

Lealta will accept no responsibility for the inability of a Participating Outlet to supply goods or services requested.

Lealta shall have no liability to you by reason of any representation (unless fraudulent) or any implied warranty, condition or other term, or any duty at common law or under any express term of these conditions for any costs of travel, accommodation, loss of expectation, other financial or like loss or any indirect, special or consequential losses.

Notices

All notices given by you to us must be given to Lealta at Lealta House, Amy Johnson Way, Blackpool Business Park, FY4 2RP or info@lealtabenefits.com We may give notice to you at either the e-mail or postal address you provide to us when the Card is issued to you . Notice will be deemed received and properly served immediately when posted on the Website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee and confirmed as received and read.

Transfer of Rights and Obligations

You may not transfer, assign, charge or otherwise dispose any of your rights or obligations arising under these terms and conditions, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under these terms and conditions at any time during the validity of your Card.

Events Outside our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control ('Force Majeure Event').

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  • Impossibility of the use of public or private telecommunications networks.
  • The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any these terms and conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.

Privacy

When you use your Card you acknowledge and agree to be bound by the terms of our Privacy Policy which can be found here.

Waiver

If we fail at any time to insist upon strict performance of any of your obligations under these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under these terms and conditions, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability

If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Entire Agreement

These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the Card and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

Our right to vary these Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that the Card is issued to you, unless any change to these terms and conditions is required to be made by law or governmental authority or if we notify you of the change to these terms and conditions in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of notice of the change of terms and conditions.

Third Party Rights

Except for our affiliates, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions but this does not affect any right or remedy of a third party that exists or is available apart from the Act.

Law and Jurisdiction

These terms and conditions are governed by English law. Any dispute arising from, or related to, these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
